According to the Criminal Code, it is illegal
to keep or be found in a common bawdy-house
(s. 210);

So what then is a bawdy house? An incall consisting of some apartments? What about an incall at a motel/hotel?

Definitely. This clause has also be used to prosecute people found in a strip cub offering "full service". it has to be read very broadly.

That being said, if they really wanted to bust everybody illegal, it would be easy to do by reading this board and the classified ads in most papers. So, as said above, the LE are quite tolerant unless you cross the line on certain aspects (underage) or someone complains.

I can tell you from 1st hand experience that the police use the Bawdy House definition for downtown contact clubs when it serves their purpose. I had to cough up $250cdn for "bail"!:mad: Their purpose was revenue collection!

Selective enforcement to the extreme.

I'm from Mississauga but have been living here in Montreal for 4 years. Never did the scene here since I was involved in a long term relationship only until recently. I'm asking questions because I want to be sure of what I'm getting into both healthwise and legally - I'm a real newbie for sure. I've done the overseas thing but it's totally tolerated there so I was never worried about any illegalities.

If she is going to your hotel room, no problem. If you are going to see her at her place, be it an appartment, a hotel room, or onyother place where she has clients go to her, then it is a bawdy house. So there you go, in calls are illegal, where as out calls are legal.

When I was in Frankfurt I`ve seen my only and the most beautiful bawdy house. It was a big old glamourous apartment building in downtown reminding me of the Bay on St Catherine but with nice balconies. Each balcony was lit by red lights. On each balcony there were mannequins sitting in the chairs dressed up as companions and clients. The companions were dressed in burlesque dresses, garter belts and corsets. The clients were wearing black suits with bow ties. Some balconies had both a girl and a guy flirting, others had just the girl `watching the street`. Some had just a John perhaps waiting for the girl in the room to freshen up.. or taking a break from the hot session.

It is really a shame that the bawdy houses in Montreal have to take a form of hidden cheap apartment banks. But then again if bawdy houses were legalized I would imagine Cleos will be the first to become an FS club and I would have to switch jobs:( ..

The term "bawdy house" is not used very much these days, the boys in the morality squad of the Montreal Police interpret this term for their own use when it suits them. These days places only get busted when there is a signed complaint. There are some places like the PUSSYCAT that openly tell people on the phone what extras they can get, to my knowledge they are still existing.

So this would imply that an incall at a motel/hotel would probably be safer than in a residential apartment building because at a motel, nobody would likely complain. I would assume that the motels want the room business and nobody else would complain unless there is excessive noise. I can see that if there's always strangers walking in and out of a residential place, then there might be a higher likelihood of neighbours complaining. So maybe I should stick with incalls that receive in motel/hotels. After reading on all the posts on cinq etoile with how open they are in whatever residential area they are in, I'm quite surprised that nobody in the area has formally lodged a complaint yet.

?? The Criminal Code certainly does discriminate. See Ronnie's link to the Criminal Code, Section 210. The person owning or operating is charged with keeping a common bawdy-house. The SPs are charged as "inmates", and the customers as "found-ins". These are summary charges, which I believe could mean that these charges can be dismissed if the owner or operator is acquitted of the charges of keeping a common bawdy-house. You should check with someone who is a lawyer if you want to make sure.

Although it's not specifically mentioned in the definition, I think the place has to be proven to have been used, not just once, but repeatedly for the purpose of prostitution (or acts of indecency) to be considered a common bawdy-house.

No, that's not correct. Technically there has been no "soliciting" law in Canada since it was changed in the 1980s. Once again, see Ronnie's link to the Criminal Code. The relevant section is 213. It is public communicating for the purpose of prostitution that violates section 213 -- that is, communicating in a public place. A hotel room, inside your home, etc., is not a public place. The law applies mainly to street prostitution, although I've heard some claims it could be argued that it applies to bars, SCs, hotel lobbies, etc.

Your mere presence (without lawful excuse) inside a bawdy-house is enough for police to charge you with being a "found-in", if they want to charge you. You don't have to be caught doing anything.

And it is possible to have an outcall SP come to your home or hotel room without violating the Criminal Code. Police can charge agencies (or their employees) under Section 212, with procuring/living on the avails of prostitution, but this likely would not involve charges against the SPs or customers if they were participating only in outcalls.

Yes. Some Australian states have changed their laws, which were previously very much like Canada's, to allow brothels. It allows the owners to spend money on the buildings, since there is no threat of them being closed or forced to move by police. See the photos of the rooms in Stiletto, a bordello in Sydney AUS.
