Bonjour,

Afin d'exprimer clairement la malencontreuse situation d'un ami, je vais utiliser la langue française, en espérant que quelqu'un aura bien la gentillesse d'en faire une translation représentative.

Je viens de recevoir l'appel d'un ami concernant une situation peu ordinaire. Un peu non-chalant, ce dernier n'avait pas fait ses impôts depuis 2003. Donc récemment il a rempli la documentation tel que requis pour découvrir les deux (2) choses suivantes:

1- Il obtenait presque 2000$ du fédéral
2- Il en devait presque 7000$ au provincial

Raison du point 2: Il a travaillé pendant deux (2) ans pour une compagnie américaine qui opérait a Montreal et cette dernière a omis de retirer la cote du provincial malgré que la loi exige les compagnies américaines d'effectuer l'administration tel que prescrit au Canada (Québec).

Le tout se déroulant a l'intérieur de cinq (5) ans.

Selon mes connaissances, malgré qu'il n'est pas fait ses impôts depuis 2003, je ne crois pas qu'il doivent assumer entièrement l'erreur de la compagnie. Toutefois, il se peut, étant même moi loin de cette règlementation depuis un certain temps, qu'il n'y ait plus aucune loi (Loi des travailleurs par exemple) qui lui permette de se départir d'une part de cette responsabilité, et du même coup d'une par de cette dette.

Quelqu'un est-il suffisament ferré pour offrir quelques conseilles???
Ou devrais-je passer des journées sur le téléphone a essayer de soutirer les informations nécessaires pour aider mon ami...en sachant que le personel de référence travaille surtout a faire tout pour ne pas payer les gens !!!

Malheureusement je ne suis pas bon en matiere de fiscalité. Mais, je pense que tu as raison; la compagnie doit assumer sa responsabilité.

I'm no tax lawyer but I know a fair amount about the principles of the tax man thanks to our business. I think your friend has problems. While companies are obliged to submit appropriate amounts of taxes for their employees, the employee has the ultimate responsibility to file tax returns annually and to pay whatever taxes may be owing. I am fairly certain that the tax man will not care if the employer did not submit sufficient taxes except for one case: if the employer documents witholding a certain amount for taxes but does not submit them to the government, then they are the hook for that amount plus whatever interest. However, if the submission to the taxman match up with the employee's T4 and the T4 actually represents what the employer paid out to the employee, then the employee will be responsible for any shortfall.

If your friend did his taxes himself and came to that conclusion on his own (amounts owing), I would suggest he contact a tax specialist, preferably an accountant, to redo and verify his taxes are as he says. If it turns out to be that, a good tax accountant should be able to help your friend negotiate payment terms with the government. I will PM you some additional info.
