In the old days there was a clear distinction between independents and agency escorts but now things have become fuzzy. Many independents have someone managing their web sites, posting their ads, deciding their rates, providing transportation, getting their email (sometimes answering them), or even handling their voicemail. Independent entrepreneurs need to pay for support services but in many cases it is difficult to figure out who is the employer and who is the employee. Can we come up with a definition or a test for a real independent? For example: an escort who communicates directly with clients and sets her own fees, irrespective of whether other supporting services are provided by a third party.

Good idea, Robin. The line has been, I think purposely, blurred recently.

I would think an independent, at a minimum:

- does not pay someone else a percentage or a fee for each client she sees. This does not preclude her having normal contractual agreements for clerical and web services.

- does not travel to client in the company of other girls. This would be so agency.

Problem is, some girls are independant some times, agency other times, and often do both at the same time. Some girls work for agencies on some nights, and book themselves on other nights...

Not sure how to do the math on this!

Thought I would clarify my position. I am in transit. I was working for agencies, then started advertising on my own. At the moment I go on call with those agencies when I do not have any dates of my own booked. (Even when I work for an agency I prefer to drive myself and save the driver fee.) So where would you classify me?

That's a good simple test. This may not work for escorts who leave their phone on voicemail. Also, there are escorts who use email instead of the phone to book clients independently and it's hard to distinguish their responses from those of an agent fronting for the escort.

I'm not going to mention names but we all know of certain agencies that advertise that they're Independents, but they have someone called their "email handler", or "booking agent", who only book appts. via email for these supposed Indies.

This is done solely for legal purposes and has been discussed at length in previous posts so I will not go into further detail. Just thought I'd provide the definition of Independent.

based on that definition, I AM INDEPENDANT!

I may use agencies but am in no way dependant on them. They do not influence, guide or controle me.

If I have no bookings on a night where I want to work there are a couple which I call and let them know that I am available; and since I have my own car, they needn't send a driver to pick me up. I am not loyal to any of these agencies.

test to see wether independant or employee

This test is based on a similar one in the May2002 issue of Siren. Yes answers indicate indepandant worker, no's indicate employee.

1> Does the worker supply own materials?
2> Does the worker supply their own tools and equipment?
3> Can the worker decide her own hours?
4> Can the worker refuse a job?
5> Is the worker bound by the principal's rules/policies?
6> Can the worker take time off whenever she desires?
7> Is the worker liable for taxes?
8> Does the worker advertise for work?
9> Does the worker invoice the principal?
10> Can the worker make a loss from their activities?
11> Does the worker have her own client base?
12> Does the worker have her own accounting system?
13> Does the worker benefit fromincreased productivity?
14> Does the worker pay any overhead related to the job?
15> Can the worker simultaneously ork for another principal?
16> Is the worker liable for GST (assuming revenue over $30,000)

Two things: Independent-network always has been and always will be an agency.

An independent is one who collects and disburses her own fees. She may hire a driver or a receptionist, but she pays them, not vice versa. An agency girl is paid her split from the gross she collects. It makes little sense for an independent to hire a secretary. An independent is by definition the sole proprietor. She would want to be proactive in managing her interface with customers, one of the main reasons she becomes independent. Her reputation is based on the way SHE handles her business, not that presented by her secretary. To the extent I would like to have direct contact with the lady, I wouldn't have a problem with initial contact with an agent, but I would want some personal communication with the escort prior to consumating the appointment.

True,
I would call the ability to contact direct a necessary but not sufficienct condition.

But I have never booked an "independent" that wouldn't contact me direct prior to a date. Afterall, that is one of the benefits of dealing with an independent lady, ie. you have the chance to communicate directly with her about her services and the date. If you can't do that, there's no way you know she's an independent.
