In Quebec can't discriminate against lying murderers

A Montreal school board has been ordered to rehire a teacher who failed to disclose that he had been convicted of killing his wife in1990.

Ginette L'Heureux, a spokesperson for the Quebec Human Rights Commission, said Jean-Alix Miguel has the right to earn a living.

"If you're a convicted pedophile, you can't get a job in a daycare. If you're an arsonist, you can't get a job as a fireman. But if the crime is not related to the job, you can't be discriminated against," she told CTV Montreal.

Miguel pleaded guilty to manslaughter in 1990 after a heated argument with his wife at their home on Montreal's west island.
He was sentenced to seven years in jail, and upon his release in 1998, he was hired to teach electronics at the Montreal trade school Ecole des metiers de la Construction de Montreal.

On an application form he filled out for the job, Miguel said he had never been convicted of a crime.
It wasn't until 2004 that the school discovered Miguel's criminal record, through a worker's compensation claim, and terminated his employment.

Miguel's union challenged his dismissal, and an arbitrator has ruled that under the Quebec charter of rights, he can't be fired for a crime not linked to his job.

It also ruled that he suffered a psychotic episode at the time of the crime and likely would not re-offend.

The school board appealed the decision to the Quebec Superior Court, but it was upheld.

School board spokeperson Louise Richard said on Thursday that officials are studying the case and considering whether to file another appeal.

Several students at the school where he worked had mixed feeling about the case.

"Personally, I don't think he should be re-hired. I think he should be in jail," said one student.

Another argued Miguel had paid his debt to society and should be free to return to work.

Que je sache il n'y a pas de sentence "vie" ici ? C'est 25 ans max je crois, je me trompe p-t.

De plus, il n'enseignait pas à des enfants, je ne crois pas que l'école des métier de la construction s'adresse à un des enfants ou adoslencents, donc l'aspect parent qui s'inquiète pour son enfant, bof ... ce sont des adultes.

Les sentences à vie existe au Canada mais, avec les libérations conditionellis, râres sont ceux qui se termine par une vie. 10 ans, 25? Et avec toutes les négotiations entre la couronne et la défense, souvent un accusé plaide coupable à une accusation moindre et, en récompense, pour avoir plaidé coupable, comme le cas sera réglé plus vite, il obtiens une peine moins grande.

Pour ce qui est du cas ici, et ça a été la même chose avec Carla Homolka, la personne a purgé la peine imposée par le système donc, il est irrelevant de savoir si le système a bien fait ou non, la personne est maintenant libre de réintégrer la société.

Le crime en était un de passion donc, peu probable que le milieu d`enseignement, loin d`être avec de très jeunes enfants, soit propice à une récidive. C`est pas comme si le gars avait attaqué un inconnu sur la rue qui l`avait regardé de travers. Attaquer sa conjointe est horrible mais, psycologiquement, le processus menant à l`attaque est plus facile à retracer qu`une attaque anonyme sur un coup de tête. JE RÉPETE: C`est horrible autant qu`une attaque anonyme, et même pire si on tiens compte de la confiance trahie! Seulement une attaque anonyme est plus difficile à expliquer psycologiquement et révèle des troubles plus profond, d`ou le risque de récidive plus grand si les causes ne sont pas découvertes entièrement.

Ou il y a un problème, et il semble que ça n`a pas été mis-en-compte dans ce cas, c`est que le gars a menti sur son formulaire d`emploi. Beaucoup de compagnies et autres ont une clause sur ce même formulaire qui indique que toute information mensongère fournie, que ce soit sur le formulaire ou autre, sera considéré comme une cause de non-embauche ou de renvoi. Peut-être que l`école en question n`avait pas cette cause?

Effectively he could not be hired as a hangman or a mob hitman but he can be hired for a job that requires integrity.

The problem is that the death penalty was not and is not in effect thanks to a bunch of bleeding hearts. The lying murderer should have been executed after he killed his wife. That would have put an end to all problems in this case and would have quite justifiably removed one huge sack of shit from the world.

Manslaughter is not murder. Even in Texas you don't get the death penalty for manslaughter.

Nah...better to kill them. And this sick fuck committed murder, not manslaughter - just because the stupid-ass "justice" system chooses to call the crime by a lesser name doesn't mean that it really is.
