Maybe no complaints? No investigators working at these hours? And if they sell alchool, they are already illegal so, likely no big deal adding one more offence! Lots of these places are already operating without proper licence anyway! It's not just alchool licences, there's fire inspection, salubrity, zoning, name it...)

    Those arent the only places.........

I know of a very popular club d/t that allows smoking in their VIP lounge as

    well as the mens bathroom.

You're not breaking the rules if you dont get caught.

Of course the customers are free to visit other clubs if they are unhappy.

They don't.. They would be stupid to do it and risk getting shut down! Plus I doubt they would want everyone rushing there at 3am when all the bars stop serving alcohol just so they can keep drinking, and all the trouble that would come along with it.

True but what about the smoking? people don't hide to smoke, it's all in the open for all to see and smell!

Then what's the point? All of the blind pigs I've been to serve booze.

Angela's beside the old Station 10 served booze all night, to all comers. Including off-duty SQ and MUC coppers.

Kids these days! Worried about a little interference by John Law. Have we all become pussified?

    after hours

i believe what they do is the after hours clubs claim to be "private clubs" not public,, therefore the public smoking law does not apply

They tried that in New York, I believe. The law had made provisions for private clubs. Like, private clubs also had to comply with the non-smoking law.

Whiskey Café negotiated a smoking license for their cigar lounge, so apparently it is possible to smoke in a club. The rule is, you must have purchased the smoke from them to be allowed to consume it on the premises.

I don't think it's possible to purchase a license at any price. The cigar lounges are grandfathered, AFAIK. No new ones can be built.

As for the "private club" argument, I think the law forbids it too.

Okay, now to add my F'ed up American opinion. I live in the smoking capital of America, Las Vegas. They just passed a state law that says basically we can't smoke indoors if food is served in that area. being that we can drink 24/7 in Nevada, most bars also serve food..... wings, hamburgers, bar food. When the law was passed, quite a few bars, fired their whole kitchen staff & the rest went non-smoking. It's been over a year now and most smaller local bars are just not enforcing the no-smoking policy..... even to go as far as to set out ashtrays on the tables.

As far as drinking & smoking..... they go hand in hand, and neither should be banned. As far as smoking in Afterhours Clubs, what the F are you doing at 4AM in a dance club anyway? And how does that smoke bother you? Does it take away from your Ecstasy or GHB High? If you just like the music, why not just go to the Picnik Electronik?

While I am a smoker, I am all for banning smoking in any family oriented business, but any place that serves hard alcohol, is not a place for kids and should allow people to smoke there. It makes me sick when I see a family with young children sitting at a table with their parents, at a bar, while guys nearby are doing shots and swearing with every other word. Since Vegas adults are not the smartest, we need to have laws not banning smoking or drinking, but banning anyone under the drinking age from entering. Let the adults decide for only themselves, not their children

By the way, I love smoking Djarum Blacks in Circus! I didn't get high, but I had many drinks before I got there. I hope more places in Montreal, get away with allowing smoking in them....... although, it is kind of fun to go hang out in the smoking areas outside of clubs, where you can actually talk to people without screaming...... smokers by design are more socialable people...... we never know when we are going to need to bum a smoke or light off a stranger.

Problem isn't only with customers visiting these places: some peoples actually have to work there!

Since everybody is entitled to work in a safe environment, nobody can be forced to work in an environment where it is unnecessary unsafe and,, second-hand smoke is harmful to them also.

As far as saying they just have to work elsewhere, well, it just doesn't cut it as we are talking about people's health here and their right to work. That's supercedes other peoples right to gain some pleasure by killing themself.

Working at 2 AM, 2 or 3 nights a week, cannot be considered a career at anything. Yes, people should have a right to work in a safe enviroment, but people should first understand that even without the smoke, that working in a drug den posing as a dance club, is not a safe enviroment. Any intelligent person, who's first priority was their own health, would not choose to work in a afterhours nightclub, and they already know about the lax enforcement of the smoking laws.

As far as people's right to killing themselves, alcohol will kill many more innocent bystanders, than second hand smoke. I believe Heart disease is the number one killer right now, should we ban Poutine and all fatty foods..... you know even if you don't order the Poutine, if your friend orders it, you will poach a bunch of his! I don't even live in Montreal, but I am addicted to that fatty goodness.......especially in the winter time!

Can't we all just have our own niche or place that we can call home & be ourselves, even if it isn't the smartest or healthiest thing to do. Isn't having fun & enjoying life just as important as working hard or paying taxes? I hope the Afterhours clubs stay just as they are! I hope to visit "Stereo" next trip. No, I am not Gay, but I do love Trance music and I have been told that Stereo, has the best sound system & DJ's in Montreal.
