Most states have enacted criminal statutes specifically proscribing assault on elderly persons (usually over the age of 60) and meting out harsher penalties and this case is a good example of why those statutes exist. In this instance I would think that a manslaughter charge might be more appropriate than homicide. From what I read about the incident the son was surprised when the father fell down. If so this would belie an intentional homicide. But prosecutors sometimes overcharge in order to extract a favorable plea deal, so intentional homicide is a possibility if the force exerted on the elderly man was potentially deadly force or reasonably should have been viewed as such.

I am aware of a case in which a 350 pound gorilla/ex football player got into a shoving match with a guy who owed him money, pushed the guy not very hard, the guy tripped and fell and hit his head in such a way that caused a fatal brain hematoma/hemorrhage. In that case manslaughter was charged, despite the size and strength of the defendant.

I'm guessing involuntary manslaughter is what he ends up getting... The news coverage tonight was a bit on the ridiculous side.

Tonya Harding reaches out to Nancy Kerrigan

Tonya Harding has extended her condolences to former skating rival Nancy Kerrigan after her elderly father's sudden death on Sunday.

The feud between the skaters became notorious in 1994 when Harding's ex-husband allegedly hired a hitman to injure Kerrigan's knee before a U.S. championship.

Harding has always maintained she was disgusted by the attack -- and now she's reaching out to her former competitor to express her sympathy after Daniel Kerrigan's tragic death.

"Tonya feels very sad for Nancy and her family and extends her deepest sympathy and condolences to them," said a statement from Harding's representative. "Tonya's beloved dad, Al Harding, passed away this April, so she understands the grief Nancy and her family are feeling at this time."

Kerrigan's brother Mark was arrested amid allegations he assaulted his dad moments before he passed away at the family's Massachusetts home.

Mark Kerrigan, 45, has since pleaded not guilty to assaulting the 70 year old.

At the time of "Wounded Knee" redux I asked my friends: If you could dine with either Nancy or Tonya, who would you choose? I chose Tonya. I must say I grew fonder of Nancy (despite the double superlative) on learning that:

And after skipping the closing ceremonies to be in a parade at Disney World, her $2-million sponsor, Kerrigan, riding on a fire engine with Mickey Mouse, complained : "This is dumb. I hate it. This is the most corniest thing I have ever done.

What say yee? Who would you have chosen?

I hate to sound elitist, but even in her prime, Tonya Harding was not do-able, imo.

I agree. I've always looked upon Nancy Kerrigan as classy, whereas Tonya Harding nothing but white trash.

Kerrigan was robbed of a gold medal that year, only to be overtaken by that drunk Oksana Baiul & her stupid 'swan' skate....which wasn't even a skate, but more like a ballet dance. The european judges gave her the gold for political reasons & for the fact she had a very unhappy childhood. It had nothing to do with skating.

Finally, a sport on ice in which you actually make sense in! ;-) LOL! On a serious note you're 100% correct, Kerrigan got screwed in 94! Given a choice of doing either, Kerrigan by a landslide!

I wasn't thinking about sex (a fairly rare event)... I was thinking that a conversation with Tonya would be pithy and robust, not vanilla.

Wait until i start posting about one of my other favorite sports, CURLING !!! :D

Any sport where it is perfectly acceptable for a woman to repeatedly yell, "Hurry, hurry. Hard, hard." is worth watching.

Rather watch curling than figure skating any day - with the possible exception of when Katerina Witt wore that black outfit at the Calgary Olympics. http://www.fanpix.net/picture-gallery/729/918729-katarina-witt-picture.htm

Jennifer Jones is surprisingly hot compared to Kerrigan who oddly, and sadly, bore a resemblance Elsie the cow facially. I think it was her teeth. Yes she was screwed because she was definitely the favourite and back in those days the favourite always won as it was largely pre-determined by the judges beforehand.
