So just to clarify , can someone please provide for me the legal differences on the law on escorts in Montreal compared to the United States?

I'm from the united states and the police will often set up stings so you will be prosecuted.

I did some research and people are saying mixed things like only solicitation on the street or in call/brothel is illegal BUT out call escorts are legal and you can discuss what you want in a private setting/home or hotel ... Is this true?

I appreciate all the advice everyone has given me , ive never used an escort yet, this will be my first time in Montreal. And yes I read the threads for first timers, but still never received actual information on the legal statue involving escorts in Montreal. I want to be 100% safe.

Outcall is 100% legal in Canada, provided that the sex worker you are meeting is adult. You can discuss anything you want in a private setting/home or hotel. In-call is illegal. However, there is a tolerance as far as it is not linked to organized crime, pimping, drugs and minors. But there is something you cannot control: neighbors' complaints. LE has to intervene when complaints occur. If you know nothing about Montréal, you may want to stick with agencies or indies providing out-call to your hotel. The best advice I can give you is to stick with the agencies and indies advertising here on merb AND read the reviews before making the call.

Yes outcall is totally legal in canada not like the states and its alot cheaper and better quality so no need to worry about getting busted

I couldn't find the actual statute, and I hate to rely on Wiki totally, but below is a what I could find.

The activities related to sex work that are prohibited by law include operating a premise (sexual services establishment or brothel) where such activities take place, being found in such an establishment, procuring for such purposes, or communicating such services (soliciting) in a public place are illegal, making it difficult to engage in prostitution without breaking any law. Automobiles are considered public space if they can be seen. Canada is a federation, but criminal law is a federal jurisdiction. On the other hand, working as an independent sex worker and private communication for such purposes (telephone, internet, e-mail, etc.) is legal. This ambivalence can cause confusion [2] [3] leading to one judge referring to the laws as 'Alice-in-Wonderland' [4] and the Chief Justice of the Supreme Court as "bizarre". [5]


Maybe someone can find the statute, but here it seems to say, all business must be privately done between adults.

On the other hand since living off the avails is still illegal...yes they can raid escort services,and accused the drivers and the owners,receptionist etc of proxenetisme.

Here is the reference, article 213 of the Criminal Code of Canada:

213. (1) Every person who in a public place or in any place open to public view
(a) stops or attempts to stop any motor vehicle,
(b) impedes the free flow of pedestrian or vehicular traffic or ingress to or egress from premises adjacent to that place, or
(c) stops or attempts to stop any person or in any manner communicates or attempts to communicate with any person
for the purpose of engaging in prostitution or of obtaining the sexual services of a prostitute is guilty of an offence punishable on summary conviction.
Marginal note:Definition of “public place”

(2) In this section, “public place” includes any place to which the public have access as of right or by invitation, express or implied, and any motor vehicle located in a public place or in any place open to public view.

Basically, Tony, if you are looking for the safest way, do not communicate with a sex worker in a public place if it is for the purpose of engaging in sex for money. Use the phone or e-mail.

centaur, you are right, but they can't accuse a client for that, unless he is himself procuring.

I understand the law about communication but I don't really understand what makes incall more illegal then outcall. So long as its not in an actual place of business such as MP, if we do everything by e-mails or phone what difference does it make if we end up in her place or mine? If I were to get outcalls everyday at my place and neighbors complained, would we be less in trouble then if it were incall?

Are indy that work at home as illegal as agency incall?

Technically, why can't hotels be considered bawdy houses if they knowingly give access to outcall escorts? They sure make a profit out of it.

Anyway I never really discussed anything explicitly with the nice ladies; some things are beyond words :)

Siocnarf, prostitution is legal in Canada and has always been. Historically, Canada is what we call a prohibitionist country, like most countries in the world except Asia. Prohibitionism, as applied specifically to prostitution, means that we consider it immoral, contrary to our values. However, policy makers think that making it illegal causes too many problems. So they have developed policies with 2 specific aims: public order (forbidding transaction in the public space) and some minimum protection for the sex workers (forbidding pimping and bawdy houses). The definition of what a bawdy house is was refined progressively by the courts and the parliament to become any place regularly used for prostitution including the private house or the rented apartment of a sex worker.

Of course, it is not quite clear that these measures succeeded in protecting the sex workers. In fact, the recent court decisions in Ontario accepted the evidence that the way it works now is worst for the sex workers than if no such provisions existed in the criminal code.

Hotels may be considered bawdy houses when used for prostitution when the room is provided with the service. Recent court decisions in Montréal and Québec have condemned hotel owners for such practices. However, if the client pays for the room, it is a private place where he can legally receive a sex worker. In such a case btw, the hotel does not make profit out of prostitution. It makes profits out of client renting a room.

This is not quite correct. The court changed the law on "living off the avails". It is now legal for someone to work for an escort as a receptionist, driver or body guard. What remains illegal is living off the avails “in circumstances of exploitation” -ie. being a pimp is still illegal.

Thanks for the precisions gugu. But to me, when the room is rented for 4h for the sole purpose of prostitution, that still sounds like their making a profit with prostitution no matter who pays for the room.

Your logic it totally off base. Using your logic, Jean Coutu is guilty for selling you a condom that you will use with a prostitute, the STM is guilty for selling you a bus pass that takes you to the Chablis. I could go on and on.

i booked the centre ville delta in montreal but had to cancel for family issues , so i have to book another . im looking for a high class one that is laid back , any suggestions?

Tony: I am also an American. I go to montreal once or twice a year to see women and I feel perfectly safe doing it. If you call a reputable agency, keep your head about you, stay in your room, treat the lady with respect and don't find some way to make an asshole of yourself (like hanging your ass out the hotel window or calling maid service and asking them to join you), you will have no problem at all. Perhaps seeing Tony's attitude will let some of you who live in Canada realize just how horrible the situation is in America.

Yeah your absolutely right bro. I am proud to be an American, yeah that probably sounds lame to some people but thats the way we grew up ya know. But the system here is ridiculous on certain offenses, and I just dont trust it. I mean i know people who got into trouble with this stuff and other offenses that are just stupid. the cops like to rack up as many offenses as they can think of once you get arrested especially if you get some hard ass cop.

to ROBINX : no it is still illegal as this judgment only apply in one year to give time to the governement to edict new laws ruling this activity but anyway the government is refering to the Supreme court...so the laws still stand the way they were in the meantime...sadly

centaur, almost! The one year stay applies to bawdy houses. The stay about living off the avails is 30 days. In both cases, it applies only in Ontario.

The federal government has announced wednesday that it will appeal the judgment. Morris, the federal counsel attorney, said he will ask for a stay on both issues until the Supreme Court ears the case. It is quite clear that he will get it on the bawdy houses. It is not clear yet that he will get it on the living off the avails. It is estimated that it will take approximately 2 years before we get a judgement from the Supreme Court.

Well you're literally off-field :) The point of my point was what constitute a bawdy house? Its not illegal to sell accessories that will be used by a prostitute and its not illegal to move sex workers about town so long as you have a proper licence to do so as I'm sure the STM has.

My logic was not aimed at making the hotel guilty, just to point out that there's no reason why incall at an hotel (or private home) should be more illegal then an outcall. You have the same bunch of ladies using the same hotels over and over again with different men. Whoever makes the business transaction of "getting" the room is a technicality.

The only times I did outcalls, twice with the same women, first time she got the room and second time I got the room. Why would the first make us criminal and not the second time?


And Tony for your question about hotels, I was once was at the Chablis Cadillac in the east of town and the other time at the Motel Ideal on Lajeunesse street in the north of town (near Sauve station). Both seem well used by outcall escorts, but they're not high class. Anyway, you would have more fun staying downtown if you want to visit the city.

I really don't follow your logic. A bawdy house is a place where the same seller is selling their sexual services on an on-going basis.

With the hotel situation, you rent a hotel room. It is considered to be a private place under Canadian law. Because you hire a some prostitutes over a few days, it is not a bawdy house. You are not selling prostitution. The person you are inviting is. And they are not setting up shop in your hotel room.

I don't even think the incall places stay in the same hotel for a long period of time. Correct me if I am wrong, but the original intent of the bawdy house law was to discourage permanent places of prostitution and aimed at the seller, even though if you are caught being in a known bawdy place, you can be prosecuted.

In the solicitation part of the law, the hotel room is considered a private location and discussion of sexual services is allowed.

I don't think you have anything to worry about in Canada as long as you are in your rented hotel room.
