Maine Zumba instructor nabbed for prostitution

Alexis Wright, putting Zumba fitness on the map, thanks to the special encounters she provided in her Kennebunkport fitness studio, until she recently got busted:

But the talk of the town these days is the arrest of a local fitness instructor who's been charged with running a prostitution business out of her Zumba dance studio and secretly videotaping her encounters. Now the town is on the edge of its seat, waiting for the revelation of which of their friends and neighbors are among her more than 100 alleged johns.

"There's still some of that puritanical New England left around," said Will Bradford, who owns a copy shop in town. "There are places in the world that would laugh at this."

(...) Prosecutors haven't detailed why Wright would have been videotaping her encounters. But they gathered more than 100 hours of video and nearly 14,000 screen shots from seized computers, Deputy District Attorney Justina McGettigan said.

"The state's in over its head. This case isn't ready for prosecution," Daniel Lilly, Strong's lawyer, said at the hearing.

    (...)
Police have begun issuing summons to Wright's customers and will release the names in the weeks ahead. Townspeople say they've heard that lawyers, doctors, law enforcement officials, a television personality and other well-known people in town are included in a detailed clientele list police found.

Wright was also an exhibitionist who made available online, some very explicit content:

Update on Zuma Trial In Maine

ALFRED, Maine (AP) — An insurance agent charged with promoting prostitution deleted all the email from his office computer a day after investigators raided his mistress' Zumba dance studio, office and home, a law enforcement computer expert testified Monday.

Frederick Williams of the Saco Police Department told jurors that he found spreadsheets, tax documents and snapshots from Skype video chats on defendant Mark Strong's computer and on computer equipment belonging to fitness instructor Alex Wright, who's accused of using her Zumba studio as a front for prostitution.

Jurors weren't told of sexually explicit images on Strong's computer that prosecutors contend show he knew about the prostitution. The defense said showing the panel the more than 500 photos would be prejudicial.

"It's going to horrify some of these people to the point (Strong) is not going to be able to get a fair verdict," defense lawyer Daniel Lilley told the judge while the jury was out of earshot. He said it was a "stretch" to say possession of pornography meant Strong knew about prostitution.

On Tuesday, jurors were asked to report to duty several hours later than usual so Justice Nancy Mills and lawyers can discuss several motions and evidentiary issues.

One issue up for discussion was whether personnel records of Kennebunk police officers must be turned over to the defense, which intends to attack the integrity of the chief investigator.

Also up for discussion was Lilley's motion to dismiss all remaining counts because prosecutors have repeatedly missed deadlines for turning over documents.

Monday's testimony focused largely on 86 items seized from Strong's Thomaston home and business in July, months after police raided Wright's home, studio and office in Kennebunk on Valentine's Day.

Williams, the police computer expert, examined computers and hard drives, and said Strong deleted all his email before Feb. 15, 2012. He also was able to recover pornographic snapshots recovered from Skype video chats between Strong and Wright.

A state police detective also testified that 41 items — including much of the computer equipment and hard drives — remained in state police custody but that one hard drive was included in 45 items that were placed in the custody of Kennebunk police investigator Audra Presby.

The defense contends police targeted Strong, who held a private investigator's license, because he was looking into unprofessional conduct by Presby and other Kennebunk officers. The hard drive that ended up with Presby contained details of Strong's investigation, the defense says.

Strong helped Wright launch her Pura Vida dance-fitness studio by co-signing for her lease and loaning money with commercial notes that she repaid with interest. He contends he didn't know anything about allegations of prostitution.

The prostitution scandal attracted international attention after it was reported that Wright had ledgers indicating she made $150,000 over 18 months and had more than 150 clients, some of them prominent.

Both Strong and Wright have pleaded not guilty. Wright will be tried later for dozens of charges that include prostitution and tax violations.

Tax related charges? Really? On a job that she can't put down on her tax forms because its illegal? I'm sure that's because they can't get hard enough charges on solicitaion alone... In the US... they always nail you with taxes...

Janus, She can most certainly report the income on her tax return from prostitution and is in fact required to do so. While most escorts do not list the occupation as prostitute or call girl (choosing model or escort instead), it would not be a problem of she did list prostitute as her occupation. The IRS cannot by law contact another law enforcement agency and have them conduct a criminal investigation if all taxes have been paid. This is because a person waives their fifth amendment rights when signing an income tax return. It does not work the other way, unfortunately. If law enforcement prosecutes a lady for prostitution, they can contact the IRS to have them see if she reported the income. This is likely what happened in this situation. But if she tells the IRS she is a prostitute and pays her taxes, it remains a secret between them.

It is much better for an escort to report all of her taxable income on her tax return. The potential federal charges for not doing so are a lot more serious than any state prostitution charges. Another problem with not reporting the prostitution income on a tax return is that many providers receive "welfare" benefits that they would not be entitled to if they properly report all of their taxable income.

Usually when an escort agency is involved, they are never prosecuted for anything other than income tax evasion. A good example was the Emperor's Club which was the agency that ex Governor Eliot Spitzer was using. They were prosecuted very aggressively because it was a huge business in NYC making millions and avoiding payment of millions in tax revenue to the IRS.

Neither Eliot Spitzer nor the escort he met, Ashley Dupree, were ever charged with anything although the feds had wire transfers Spitzer made in his own name from his own personal bank account to shell companies designated as payees by the Emperor's Club.

The prosecution in Maine is likely motivated by political considerations but the prosecutor will prosecute what he can prove, and when tons of money is being made and no income is being reported, it is pretty easy to prove a crime assuming you have proof of the income. This is why money laundering skills become important. The Zumba was apparently the money laundering operation to hide where the money was really being made.

I agree with you, EagerBeaver. What amazes me is how few U.S. escort services (or escorts for that matter) report anywhere close to all of their income, no matter how many accountants and attorneys tell them that all income, legal or illegal, is taxable. I guess the tempation to not report cash income is just too great, even though many of the escort agency owners that have been prosecuted for tax evasion are astute businesspeople. Hell, it is not even illegal to operate an escort service or be an escort in the U.S., so there would be no reason to not report it even if the IRS was not prohibited from initiating a non-tax criminal investigation. I do not know how it works in Canada. Does everyone think the agencies and working girls give the Crown (or whatever Canadians call the government) its share of their earnings?

A fascinating legal question for the technically minded in the US right now involves these SugarDaddy sites that are directed heavily toward college girls.

A college girl is paired with a wealthy man, generally a silver fox, who chooses to reward her with gifts. Often these gifts involve payments of college tuition.

The receipt of a gift does not constitute taxable income in the United States. The question of course, is whether it is in fact a gift or instead income from prostitution.

An age old question, but it is made more interesting when the web site actively recruits college girls and provides them with free membership with the use of a university email address. Not only do I suspect that most of the girls not report the cash as taxable income as a result of the payment being a gift in their opinions, but they also fill out their college financial aid form listing little or no income.

The Sugar Daddy girls have a better argument that the cash is a gift than a traditional escort, but it is not a certainty that she will prevail if challenged. I get amazed at how much a lot of US guys pay for these types of arrangements, like $3,000 a month according to many reports. But a lot of guys have a lot of money, this arrangement feels less like being a john to them, and they are of course helping a young person receive an education!

Income tax evasion is the charge of choice when nothing else will stick. See Al Capone, Spiro Agnew, etc.

The partner received his sentence. While the directing of any criminal charges against him is ridiculous, it could have been worse. Also, even though the charges against him and Alexis are vastly different, a lenient sentence for him probably helps Alexis. A lot of the American public is idiotic and simplistic. They will see him as a pimp and her as a victim (not true in either instance) and if she gets a long sentence and a large fine, it will be viewed unfavorablly by many women when compared to his "punishment".

She plea bargained. Hopefully there will be Playboy photo shoot or a porn contract. She might want to do those things before she reports to jail (if the judge imposes the recommended sentence) in case she puts on pounds in the slammer. The fact that she will get jail time is a travesty, but what can be done? It could have been worse, and if she had paid all of her taxes and not signed up for public assistance it might have been worth her going to trial.
