Prostitution IS legal in Canada

This is straight form the canadian criminal code, which can be found at http://laws.justice.gc.ca:

Offence in Relation to Prostitution

213. (1) Every person who in a public place or in any place open to public view


(a) stops or attempts to stop any motor vehicle,

(b) impedes the free flow of pedestrian or vehicular traffic or ingress to or egress from premises adjacent to that place, or

(c) stops or attempts to stop any person or in any manner communicates or attempts to communicate with any person

for the purpose of engaging in prostitution or of obtaining the sexual services of a prostitute is guilty of an offence punishable on summary conviction.

Prostitution IS legal, however, attempting to communicate in a public place or in any place open to public view with another person for prostitution is illegal.

212. (1) Every one who

(h) for the purposes of gain, exercises control, direction or influence over the movements of a person in such manner as to show that he is aiding, abetting or compelling that person to engage in or carry on prostitution with any person or generally,

Actually my reading of that is that that is what makes incall illegal, since that is the only purpose of an incall place.

However, and you'll even see this on some sites, with an agency they are merely sending you a girl that you make a donation for their companionship, anything that occurs between two consenting adults at that point is their business.

I think that is the loop hole that allows outcall to be legal.

But that's just my interpretation.

210. (1) Every one who keeps a common bawdy-house is guilty of an indictable offence and liable to imprisonment for a term not exceeding two years.

is guilty of an offence punishable on summary conviction.

Nowhere is writen that having sex with someone and receiving money is illegal....but in fact, the code is clear about ALL that is around business of sex: sollicitation, advertising, locations for this purpose, helping someone to do it, having company to sell sex service...etc...so, the only legal thing, is to do it between two people and keep it to yourself: no advertsing, no talk on the street...such make it tough to find a prositute (for Johns) or to find client (for SPs).

There was talk a few years they would crack down on newspapers such as JdM or especially the Mirror since let's admit it is the most blatant about it. The bawdy houses laws are mainly used is someone complains about the traffic/noise/drugs in the neighbourhood.

Prostitution became legal in Canada in the same way as abortion and lap dances: the Supreme Court. The bawdy house laws are still on the book but they are currently before the Supreme Court and I would not be surprised if they are modified as well in the near future.

Prostitution has always been legal in Canada. I know because I researched it for a class I took called History of Sexuality. :)
