Here's another article about the same story. He probably had some very convincing lawyers who found a loophole in the law. In this article, the prosecutor said the law was intended to apply to law abiding citizens, not those forcing someone to do prostitution. I bet since the law did not have an exclusionary clause saying that the law allowing someone to use deadly force on a nighttime burglar, or thief, does not apply to illegal acts, like drugs, prostitution, etc., his defense team directed the jury to acquit him on such a loophole. I bet you that the Texas legislature will amend this law.

Many states have laws that allow citizens to use deadly force on burglars breaking into your house. In this case, the defendant had really good lawyers.

A Texas jury acquitted a man of the murder of a prostitute on the grounds that he was entitled to shoot her because she had “stolen” his property by taking his money but not having sex with him. The jury accepted Ezekiel Gilbert's claim that he was only trying to retrieve his money when he shot 23-year-old Lenora Ivie Frago -- an escort who he met on Craigslist -- in the neck on Dec. 24, 2009, and hadn’t meant to kill her. Frago was paralyzed by the gunshot wound, and died seven months later.

According to the San Antonio Express-News, the altercation began on Christmas Eve when Frago arrived at Gilbert's home, accepted $150 from him for what he believed was payment for sex, and then left. In court, Gilbert, 30, testified that Frago spent 20 minutes inside his apartment before she left, telling him that she needed to pay her driver. Defense attorneys Bobby Barrera and Roy Barrera Sr. claimed that Frago's "driver" had been her pimp, and argued that under Texas law Gilbert had been within his rights to use deadly force to recover his stolen property.

The Texas law allows citizens to use such force to “retrieve stolen property at night” or to hinder a burglar from escaping the scene of a crime during the night, as long as the person “reasonably” thinks that they have no other means of protecting their property, Think Progress reported.

“I sincerely regret the loss of the life of Ms. Frago,” Gilbert said Wednesday. “I've been in a mental prison the past four years of my life. I have nightmares. If I see guns on TV where people are getting killed, I change the channel.”

Prosecutors argued that the act of solicitation undercut the defense’s claim, telling jurors that the Texas statute was intended for “law-abiding citizens,” not for those trying to force others into prostitution. After hearing the not-guilty verdict, Gilbert reportedly broke down into tears and hugged both of his attorneys. He told reporters outside the court that he thanked God, the Barreras and the jurors for their ability to “see what wasn’t the truth,” and to give him a “second chance.”

Think about this. Why should anyone believe that story at all? There were no witnesses and no recordings of the event. Who says there was a hassle about cash or anything? Him? The only survivor? Sure, all the apologists will say a Craigslist sex meeting is risky and he was protecting himself from a possible ripoff. But, an unarmed escort confronted with a gun threat to her life wouldn't give him $150 back, and he was forced to shoot her to get it? It sounds a lot more like he set up the escort to rip her off and killed her to keep her from talking, or just killed her for kicks like the first Craigslist Killer. Regardless, his own scenario is totally nuts, and that's besides the fact the shooting shows he valued a human life at less than $150.

That's what the Texas jury did. They valued a human life under $150, while also saying you can take a life any time someone allegedly breaks a criminal deal you are also fully culpable in, and all you need to do is say that's what happened. The jury took his word for the account of events though he was as much guilty of a crime as her by their own laws and killed her essentially because she didn't follow through with an agreement to complete the crime...according to the killer. It's a ridiculous perversion of legal and moral premise. Yet he was cleared of all responsibility in this atrocity

I find it much easier to understand OJ's escape from justice. A mostly African-American jury has to judge a trial heavily tainted with the appearance of white racist legal conspiracy casting doubt, and had to deal with going back to their own communities with their decision, but maybe also couldn't resist an underlying impulse for some payback against all the Whites who got away with murdering Blacks with the protection of racist White juries. That I could understand despite the failure of justice.

But taking the life of a defenseless person, no story of him ever being threatened much less her having a weapon, over a small amount of money to enforce what was a crime in that state...as the story stands it's a mad perversion of decent human life values. It's disturbingly insane.

Do you know if there were no witnesses? The driver was supposedly waiting for her.

The jury listen to all of the testimony and followed the law, good or bad, and found him not guilty. I don't think the jury was the problem in this case. It was the persons who wrote and voted for this law. The law probably does not have an exclusionary clause for circumstances involving other crimes. If it did, the jury probably would have voted Guilty.

About OJ; he was guilty. The black jury OJ Simpson had in the murder of his wife and Ron Goldman practiced jury nullification. There's no justification for their verdict.

I think the driver didn't come forward as a witness or to testify because he was scared and didn't want a criminal record.
The escort and the killer argued over $150 and look where it got them.She's dead and he could've been sentenced but got off the hook.All over $150...Keep in mind it could've been the other way around escort kills client.
One thing with money and good lawyers theres nothing you can't do lol

Yes maybe the story is bullshit and yeah a dead person for 150$... thats crazy. Now ask me why i don't want to use craig list or go to obscure incall locations of independant from these places. When i call an escort, its always a good reputation agency, so that from the start is the first step in good, you know damn well if they turn out to be bad, they won't be on merb very long. Then i call to an hotel in the downtown, so the escort know she is safe by coming there, and im sure i am safe also cause pretty much nobody could do anything in those public places, unless you don't care of getting caugh, but well the risk are very small.

Now of course mtl is not the states, and god knows i would never call an escort if i would go to the states, unless its a very known pornstar and a VERY SPECIAL event in my life, i would fear too much getting arrested and/or attacked.

But at the same time, even in mtl you hear all kinds of different weird stories... Guys killing other guys outside a bar just for a disagreement, or neighbors doing it also for just a disagreement... Maybe im a country boy and its just im not use to that shit, but damn it always make me nervous about MTL.... Gladly im big, strong and knows how to fight, disarm knife users and such, but you never know what can take you by surprise... or the guy can pull out a gun, in that case... your fucked...

I agree $150 is not worth taking a life. However, since it's illegal to pay for sex in most everywhere (except for a few counties in Nevada), what do you do when an escort or a driver robs you?

I don't think shooting her is the answer, so don't worry. But the problem in the US is pay for sex would be safer (not totally safe, but safer) for all parties, if it was legal in zoned areas. However, we have a government in the US that sees prostitution as a nuisance and women will be afraid to call LE when trouble arises, and so will men. So most serious problems go unreported, or worse case scenario someone gets killed. Some jurisdictions will not press prostitution if a more serious crime is committed, but not many people know where those jurisdictions are. Big problem.

No one is forced to live in Texas. There are at least 8 interstate highways leaving the state of Texas. Every few minutes there is a flight leaving either DFW (Dallas-Fort Worth International Airport) or IAH (George Bush Intercontinental Airport - Houston). Yet when one looks at migration statistics, people aren't leaving Texas. And while no one is forced to move to Texas, in terms of interstate migration, Texas is receiving more new residents than any other state.

I agree. Each state has their laws and you can live in Massachusetts where carrying/owning guns without permit, can take a long time and can land you a prison term if you don't, or in Texas, where gun registration is fast and easy. It's your choice.
