With Canada's free health care, all the girls should have regular checkups. agencies have enough trouble getting the girls to show up to work, let alone make a doctors appointment.

in this hobby the best you can do is hope the girl gets tested regularly, and if you are worried the smart thing to do is also get yourself tested regularly.

I believe FKS does require their new recruits to show proof of testing results before they're hired.

As for the rest, i have never heard of any other agency asking for proof of being std-free at the hiring process or even requiring their girls to go for regular testing afterwards. They figure it's the girls' responsibility to be std-free and/or to go for screening.

For the law-savy merbites out there: could a client sue an agency if he suspects one of their girls infected him with an std?

I don't really see how that would be the agency responsability. Perhaps you can sue the girl if you can prove she knew she had an STD. There are cases where individuals were found guilty because they had unsafe sex while knowing they were HIV+.
That is just me using common sense btw, I'm not a expert or anything.

Just assume that the girl is an HIV-carrier and act accordingly.

As far as I know, in Quebec, having unprotected sex with sbd., knowing that you are infected and not telling the partner, is a crime. Though, I can hardly imagine Peter-the-family-guy trying to sue Hornita from Outer Pleasures agency because she did not tell him about her condition.

I did not know that all the escort agencies we see out there are licensed by the city of Montreal. The second part is pure hypochrisy. When you think about it, the term "escort" is hypocretic in itself. How many Johns do pay girls just for the sake of company?

Not everywhere. It is not the case, for example, in New Zealand where sex workers are considered like any other citizen. The State agencies take every possible means to raise awareness in the sex workers community, but no law oblige them of any testing. Health is a personal issue over which the state is rarely legitimate in imposing the course of action to a specific class of people, unless some extraordinary circumstances. As everybody knows the incidence of AIDS was particularly high in the gay community at the beginning. The State would not have forced every gay person to take a test, only encourage them to do so. Same for sex workers. This is, in a few words, the position taken by most sex workers organizations here in Canada and in most countries in the world.

Escorts agencies are not the State. They may impose every reasonable rule they see fit for their business. Could a case over their ability to impose such tests be won in court? We are far from there.

It is not illegal for an individual to work for an escort agency as long as they are licensed to do so by the city. Further, engaging in non-sexual services while working for the agency is not illegal. For example, an escort who merely accompanies a john, or client, to a social gathering is not doing anything illegal. However, if it is implied that a sex act is available but will cost the client extra and a discussion ensues about price for sexual services, and if the discussion occurs in a public place, then the john and the escort are committing an illegal act (i.e., communication for the purpose of prostitution -- s. 213). If, however, the discussion occurs in a private residence, no offence has been committed.

Escort agencies rarely need licenses by the city. Most of them run out-call services. Of course, they are required to declare a business address if they have one. But that's not different from any other business. The fact that sex is available, for extras or not, does not render the act illegal. When agencies state that the money you pay is for companionship only, it is to protect themselves from accusations of pimping (it is a useless statement for that purpose by the way). As far as publicity is concerned, it depends on the interpretation of "public space". I'm not sure any accusation under 213 were ever made elsewhere then street prostitution.

It is an unregulated market. Asking questions like whether a girl gets tested implies rules and regulations where there are none. Everyone creates their own rules in any black market and you play by the rules of who you are dealing with. I guess outcall escorting in Montreal technically falls under the "grey market" while incall is the "black market", but for purposes of this discussion the technical distinction is irrelevant. It is not a legalized regulated industry. It is legalized and highly regulated in some counties of Nevada. If he wants a highly regulated escort he can go to Nevada to get one, and I hope he enjoys the prices he pays for that. The escort in Montreal are not regulated, period and end of story.
