Yes, they are real. Some of it is encouraged by the free flowing drinks and some of it is encouraged by plants that they have placed in the crowd. I don't believe that's true. In many cases, simply posting a "We're filming here" sign can be enough to show people identifiably (eg: Borat).

The legalities would be the same. But as I said above, I'm only talking about the first video. It doesn't seem any different from events I've personally witnessed (281, Cancun, Miami, ...) many times before.
