No. But the chance of you getting arrested is quite low.

If it's one on one, then the same rate should apply. If you're going to be there, too, she should charge more. Simples. I've thought about something along these lines, too, but nothing in life is free, my friend.
Personally my rate is the same whether my client is male or female. If you were present I would likely charge my couples rate. (I've never had anyone just watch, even if that was their original intention. Some participation always ensued.
