I think they make 20-30% of the settlement. They lose everything if no settlement is won. The defense lawyers will make money defending the company irregardless.

probably a wise investment. I invested mine in a bottle of Barcelo Gran Anejo, very reasonably priced at $34.25, which I'm currently enjoying.
