Seems Chief Justice Roberts, unlike the POTUS and the Rethuglicans in the Senate, is actually concerned with the integrity of the Senate. What with 2400 law professors around the country and former Justice Stevens all stating that Kavanaugh lacks the qualifications, he has now turned an ethics investigation over to the 10th Circuit Court of Appeals.

"The situation is unique in that never before has a Supreme Court appointee joined the court at a time when a fellow judge has concluded that misconduct claims against that appointee warrant review and when a former Supreme Court Justice has concluded that the appointee’s behavior was disqualifying."

Although the Senate approved Kavanaugh, they are not final arbiters of judicial misconduct under the Judicial Canons of Ethics. As I posted in the other thread, Kavanaugh violated at least 4 Canons that I read, and this is really totally separate from the MeToo issue. However, the real question at this point is what will be the penalty for the violations. There is a good chance that he will simply receive a reprimand. It's unlikely he will be compelled to step down.

Well, tell me this (if you know), Beav, considering that 2400 law professors say that his ethical lapses show that he lacks to qualifications. If the court should decide that his presence diminishes the legitimacy of the court to such a degree that he should be removed from the bench, can the court remove him, or would it have to go through the impeachment process through the House and Senate?

My sense is that Roberts has that concern about his presence.

I don't know what that court has the specific power to do. Generally in misconduct proceedings against attorneys and judges that I have seen, there is a range of penalties that can be imposed, from reprimand, and an order to take ethics courses, to suspension, to disbarment and removal. State Superior Court Judges in this situation simply do not get reappointed after a misconduct finding. As I already posted, there is zero doubt in my mind that Kavanaugh violated the ABA Judicial Canons of Ethics, for all the reasons stated in that article.

I can remember one Judge who was not reappointed because he had an affair with one of the Court reporters, who was a much younger woman, and that subsequently led to litigation and complaints when the affair went sour. He was basically a lame duck, did not get reappointed, and lost his 6 figure salary and benefits and retirement, if I recall. It was too bad because he was a good Judge and good guy, but he should not have shat where he ate. It's an absolute no no and horrendous bad judgment, at the very best, for any Judge to fuck any subordinate court staff.

With Kavanaugh, I was not swayed one bit. Some woman said she was felt up and she was coached to the nth degree in the process. One woman turned out to be a lunatic and her story fell apart during her NBC interview. As Bill Mahar said, all women should be listened to but not all women should necessarily believed. How often has perjury against congress actually ended up in anything at all? Making false statements gets used every so often, but it seems that in general, it is almost always allowed to slide. I can't remember off the top of my head the last person who got hit for it for any jail time. (I can remember some for lying to the FBI but not for lying to a committee.)
