Assuming the NDA was meant to cover a crime it would be fully or partially invalidated. An NDA could also be invalidated if a party was not independently and appropriately represented (assuming they are not a lawyer). A lawyer cannot represent both sides (classic mistake for prenups).

You can’t sign away many rights including the right to not have a crime committed against you.

On the other hand, it can be hard for a DA to press charges in intimate crimes without a cooperating plaintiff. That is why Weinstein lasted so long, casting his victims in roles was a great way to keep them silent.. while it lasted of course.

Just ask Harvey Weinstein. The answer is no. An NDA between 2 private parties offers no protection against criminal prosecution by the state. It may make it more difficult, but if the victim decides to violate the NDA, the defendant cannot use the NDA to block testimony in a criminal trial. Technically, Weinstein could go after any of these women in civil court for violating the NDAs that they signed, but good luck getting a jury to side with a rapist forcing his rape victim to pay back hush money.
