I don't want to sound too paranoid but this is still scaring the shit out of me... how dangerous can it be with the new law and all if my phone number pops in their client list with some message text saying stuff like 'Which girl available' 'Im Here', 'it was great, thanks'... I understand their primary goal is the human trafficking charges, but Im wondering if they could have any legal opportunity to charge client from the list / cellphone message alone (any precedent?) without being physically there like the two poor souls who got busted

Thanks

... and most sex workers would not give information to the police for privacy and economic reasons.

For Canadian workers, since they cannot charge sex workers they have no way of pressuring them into cooperating. If the woman is an illegal immigrant the authorities could make a deal with her. In case of human trafficking the woman would not have contact with the clients like an indy and would be unable to make a specific testimony about any one of them. They are more interested in what she can say about the traffickers.

The investigation was started more than a year ago. That's a lot of work and resouces even without looking at the thousands of clients that dealt with these agencies.

Question technique ?Pour les amateurs de droit ?

Yes I had noticed. But this case is about people smuggling: illegal immigration. The advertising offense is just one that piles up to plenty of others. When they press charges they load them as much as they can. The more they have the more bargaining power they have.

Hello all

To have bargaining power ,by putting more charges is common ,however if the charges that are added can be served concurrently does really provide more bargaining power ?

There 's is saying in Canada about the federal Police "The Mounties always gets his men "Longer investigation ,better evidence ,more Professional Policing .

The added charge of "Gangsterism" ( Seven accused will appear in court on April 29 after new charges were filed under section 467.12 of the Criminal Code (gangsterism)).is more to be feared then "Advertising sexual services"
If they make it stick

During a span of several months in early 2006, police wiretapped Carmelo Venneri’s phone calls and conducted secret surveillance outside his home, north of Montreal, establishing that the bar manager had become “an important pillar” in supplying a gang with cocaine.

While it was established that Mr. Venneri was a trafficker, he was not a member of the syndicate for whom he dealt cocaine, the Supreme Court of Canada ruled Friday, offering guidance on how courts should define membership in a criminal organization, which brings stiffer penalties.

The highest court still found that Mr. Venneri was guilty of trafficking for the benefit of a gang, for which he could face up to 14 years in jail.

But, in its unanimous decision, the Supreme Court agreed that Mr. Venneri didn’t traffic as a member of the gang, a more serious offence.

The legal concept of gangsterism was introduced in the Criminal Code in 1997 as a way to apply longer sentences against members of organized crime after a bloody turf war between rival biker clubs erupted in Quebec.

Since 2001, the designation can be applied to groups of just three people..............

Cheers
