Reading this makes it strange under new law C-36

The moral is under NO condition try to see a girl whom at one point were told she is 17 or younger! The concept of being horny does not play well with LE. LE are just regular dude like you and me and they want to draw a line. It could be their daughters... That is really how they think.

If they want to catch pedophiles wouldn't they be better to mention a 14/15 years old girl? I may be wrong on this but i think if you do not exceed a certain age gap, and you date a 16+ in your personal live it is legal. Like i said i could totally be wrong but i think i heard that somewhere.

Consent age is 16 in Canada, but not for prostitution. The sentence for buying sex from a minor, under 18, is much harsher. I agree that if the purpose was to fight against pedophilia, it would have been better to say 15 or 16. However, I doubt it was the purpose. It's a public relations operation IMHO. They would never accuse a client for the sole reason of buying sex from a consenting adult in such a setting. I have never seen such case in Canada except for street prostitution, but the true reason the do in that case is that they consider it's public nuisance. They said 17 because they want to bring cases to the tribunal as part of a fear tactic.

I've been reading a bit on law and entrapment. There's precedent that this exact internet sting tactic for underage prostitution is not entrapment

In short if there's reasonnable suspicion that there's prostitution in some ads section, then the police can post fake ads and arrest the clients. Since the guys in the present story don't get charged with underage prostitution, it's irrelevant in term of defense whether the police mentionned a 17yo or not.

An other way to think about the legality of entrapment is to consider street operations where police officers disguise as sex workers. This, without a doubt, is not considered entrapment in Canada. I don't know bout USA. Is posting adds on CL much different? The guy going to the hotel in his car is doing the same thing as the walkers stopping in front a street worker and asking how much.

This make sense. In any case i know for a fact i wouldn't pursue ANYTHING if i know she is not 18. I trust agencies from merb to hire only 18+ girls too.

Gugu, in the US it is more complicated because each state has it's own set of criminal laws and use different standards (subjective or objective) for entrapment. In any case, placing a fake ad will not be sufficient to convince someone who had no prior inclination for hiring a prostitute. If you look at those ads it means you are actively looking for a prostitute, therefore it's not considered entrapment. If an undecover cop pretended to be your friend and then convinced you to do a crime that you would not have done otherwise, then it could be entrapment.

In Canada, street stings (and now online) are called Random Virtue Testing and are allowed if part of an active investigation or operation. For exemple if they are investigating actual undearge prostitution in a location (real or virtual) police are allowed to do these stings to ferret out the clients. Same is true for dealing with public nuisance.
