On June the 13th, the Supreme Court will hear the parties in the Bedford case, one the most important one in the history of prostitution in Canada and one that will have a very important impact worldwide. If the rulings by the Ontario Superior and Appeal courts are maintained, the Canadians courts will have declared that the ban of brothels, non exploitative work by third parties and certain aspects of solicitation are contrary to sex workers fundamental rights to security.

Le 13 juin prochain, le Cour suprême entendra les parties dans l'affaire Bedford, sans aucun doute l'une des plus importantes dans l'histoire de la prostitution au Canada et qui aura un impact important sur les politiques publiques sur la prostitution partout dans le monde. Si le jugement des deux premières instances est maintenu, les tribunaux canadiens auront jugé que l'interdiction des "maisons de débauche", l'interdiction du travail de tiers qui n'en est pas un d'exploitation et l'interdiction de certains gestes de sollicitation dans l'espace public portent atteinte aux droits fondamentaux des tds parce qu'elles rendent leur travail plus dangereux.

L'organisme Stella vient de publier cinq feuillets qui expliquent fort bien les tenants et aboutissants et la positions des regroupements de tds dans cette affaire.

thanks for the update Gugu. It says on the timeline that the case is to be heard in June. Any word if that has started?

Unfortunately , the main law that should be challenged and the stupidest part of the law, the "communication " (for the intent of solicitation in a public place). provision is not going to be challenged by bedford. MAybe the SUAVE the south west Vancouver sex workers alliance (SIC) , will being that to the Supreme Court.

Thanks for the update, Gugu, and keep them coming. One question as I don't know the workings of the Canadian courts. Is there a typical time frame between the date the supremes hear a case and the date they issue a ruling?

The case is ready for hearing. It is scheduled for hearing on June the 13th.

Oh yes it is challenged, there is a cross-appeal on the subject.

Rumple, 6 months is indeed the average. You may also anticipate that if either 210 (bawdy house) or 213(1)(c) (communication) are judged unconstitutional, the court will grant a stay of at least one year to the federal government to work out a new policy. Many just hope they will procrastinate a little bit on the case to give us time to boot the Harper government. The Liberals should win the next election in Canada. It would be preferable to have them in power to propose such a policy.
