Nobody can decline to testify at trial when they are subpoenaed. The alternative is to go to jail. He theoretically could go and testify and invoke the self incrimination privilege. Depends on what he knows and what his anticipated testimony is. Without knowing what his anticipated testimony is it is hard to say.

I am not sure any witnesses are needed to this trial. Trump made very public statements and either they constitute legal incitement of a mob to riot, or not. I have no idea what Pence could possibly add that we do not already know.

Let me ask another question. Let’s say DJT himself came and testified and verbally said “yes, I incited this insurrection, I’m disappointed it didn’t work. I have not regrets.”

As long as less than 67 senators vote to remove him, he gets acquitted, correct?
