Unbelievable how 2 people want to sidetrack this discussion by asserting there's not a single attorney in Montreal who would consult on these matters, especially when it is not illegal to operate an escort agency for companionship purposes.
.

Is consultation really required for companionship purposes only ?No law being broken ?
What is required is a marketing expert ,they have it :thumb:

Hello all

In the US, most high-end escorts (and presumably escort agencies) consult an attorney about what they can, and should not, do. Through repeating a lot with my favorites, I have learned some of the things those attorneys have said.

Essentially, those attorneys will review the activities that have gotten others arrested,
Key word "arrested "If no one was arrested under the new law what parameters is there to review ?
and how the arrested person might have conducted his or her activities in a manner that would have avoided arrest. That is not conspiring with the client as to how to commit a crime.
A light interpretation ,some will have stiffer ones a some lawyers will be disbarred http://www.barreau.qc.ca/en/public/protection/vrai_avocat/index.html

That is educating the paying client as to what the law says, and how the enforcement of the law works. That counseling happens every day in all areas of the law
.
I do consult lawyers frequently .

When a law is new, it is a little trickier, since no law enforcement has occurred. But it would appear reasonable for an attorney to give his if her thoughts regarding the interpretation of the new law. Escorting is not like selling drugs. It is legal to purchase time and companionship from an escort, just not sex. That distinction allows an attorney to advise clients on how to offer and how to purchase time and companionship, instead of sex.

I have a situation that happen to me not quite a year ago in court .
I was arrested twice by the QPP with 3 or 4 girls on board and it was noted by the officer on the statement .
At the courthouse with my friend and my lawyer to negotiate a reduction of the sanctions .
That was prior C-36 came into force .
So explain the presence of 3 or for young ladies in my Van I admitted to my Criminal lawyer which is female by the way ,that I was a heavy consumer of young ladies ,which is true and was true ,her immediate reaction was its immoral even if not illegal and she told the Judge being a 63 years female will definitely be very upset .
My negotiation with the Crown went better then anticipated and agreement was reached without ever revealing anything ,but to my lawyer that I knew for 15 years and she was scandalized .;)

Hello Patron

There is validity to what you are saying .And gave a very good and appropriate information but each case being different ,the lawyer needs to select his cases .In some law firm I went I needed to be very heavily recommended so the lawyer would even agree to see me .

I do not wish to antagonize ,I am sharing some of the experience I have with lawyers over a very long period .

What I said was not a light interpretation, BookerL. I wish EB was still around. He was great at explaining things. My comments were related to the a US legal system, but most principles should be the same.

One of the solemn obligations of an attorney in the western world is to help keep innocent people from being arrested.
I fully agree with this ,provide your definition of innocent ,will even help guilty people to be acquitted

If an innocent person, such as an escort of an escort agency, that sells time and companionship consults with an attorney as to how to minimize the chance of being arrested and falsely accused
False charges can always be brought, Patron whatever the consult .I have a friend presently in Vancouver which is falsely charged with assault ,I have met is lawyer once already to talk strategies .
I spoke to him tonight ,most probably next week another meeting

of selling (or helping someone else sell) sex, the attorney can offer examples of how other purportedly innocent people were arrested, what actions likely led to their arrest, and how they could have done things differently to have decreased their chance of arrest. That is not conspiring to commit a crime or a violation of any ethics I have ever heard of. Everyone in the example is innocent (even if some of them might have plea bargained and might later have been improperly convicted).

If the lawyer really believe that the people will not be selling sex under a different pretense .
But which lawyer wants to be involve before the facts in a sex selling business ,if is advice doesn't prevent the arrest and is client are really unhappy about is advice what do you think will happen ?
Its a very slippery slop .
As hobbyist we have a tendency to forget how bad it looks for general population ,I was a Booker and also a hobbyist definitely far far from being a saint ,I favor this lifestyle but I do not consider myself innocent .

Everyone needs to look himself in a mirror

Cheers

Look behind you.
STN, and for everyone's better understanding actually:

Not that it is ever wrong to seek an expert's advice, but your take is not exactly right…

Bluntly:

Even more so now because of C-36, anyone that, nicely or not, provides help/support in any way to a SP is committing a crime.

While ‘agency escorting’ is tolerated because, quite frankly, most people are turning a blind eye, it remains illegal. Therefore, the entire ‘business model’ you are referring to is illegal.

There isn’t a lawyer in his right mind that will give advices on the best ways to commit a crime, or on which technique is working best at breaking the Law because well… one is, or is planning on breaking the Law, and the lawyer certainly wishes not to participate (in any direct or indirect way). Yes, that includes the 'business model' and management of SP agencies.

There is a world between defending a person/corporation/religious order/etc. against whom/which charges have been brought up in a Court of Law (certainly legal), and, as per explained above, “consulting” on how to commit a “better” crime (a crime in itself, conspiracy).

C

Thank you for your take on this but, never knew there were no lawyers that worked outside of the law and were completely law biding. Guessing that all the top lawyers that the mafia or bike gangs have are just C grade lawyers that are trying to get into the business.
There is a away around most things and there are plenty of lawyers who would be glad to assist almost anyone who has the right amount of cash. The consulting to commit a better crime would not have to be written down in any books as such.
Anyways there is always more than 1 way to skin a cat.
EDIT: Do you really think what goes on behind the closed doors of a lawyers office is completely legal all the time? serious.. A lawyer?

Come on Booker. The MOB has more lawyers than you can shake a stick at. Do you really think the public defender thinks his client is innocent? How about this? Maybe the lawyer doesn't believe in this law? Several would probably work pro bono. Especially in this case where the sexist, feminist-induced law is an ass!!!!

Sorry, friend, but this is laughable. This might be the first reference ever to Stephen Harper and his right wing, religious fundamentalist cronies as "feminist." I will give you "sexist."

You want to know who the feminists are: Terri-Jean Bedford, Amy Lebovitch and Valerie Scott.

BookerL, what about vogue that was supposely dead and now they announce girls for tomorrow?

I guess we all jumped the gun in declaring Vogue dead (edit: this was first suggested by ALG at the beginning of this thread), but they had stopped posting for several days and there were multiple threads asking if they were still alive with no response from the owner or anybody else, so it was a reasonable thing to assume.

The point I was trying to make (and maybe should have been clearer) is there has been no suggestion there was any LE activity at Vogue. And despite some irresponsible speculation in this thread, no evidence of LE activity at G4U, although it remains to be seen what is going to happen there.

So for the time being, the problem appears to be confined to MtlTopGirls, which was known for many dubious business practices.

If all the rumors i'm reading are true, maybe it's time for me to accept an early retirement package & move to Montreal. The time seems ripe to open my very own mega agency since a lot of my future competition seem to have closed shop. If the rumors are indeed true, that is. But they must be, right? After all, everything that gets posted on merb or any other industry boards is the absolute truth, correct? ;)

Look behind you.
Considering G4U
They have made a announcement on Friday night that they where shutting down for the week-end to come back better and improve at that moment it seemed more likely linked to economics or dispute
between the partners .
You do not re-brand after 7 or 8 successful GT"s and 2 in a row "Best Agency "of the year and also with the 'BEST GFE" "BEST ROOKIE " of the year ,those situation are speculations they are facts .

Another fact is you do not remove your Threads your Website for economic purpose or a dispute .You do this when you scared or tip off or both.
If at anytime in the operation of a escort agency ,underage where hired ,mistreated by any member of the management and LE becomes aware of it by complaint arrest in thie business are imminent ,If the right hand doesn't know what left has done ,well sadly both hands are responsible .

Like to see how this plays out in the end. Love it when facts are involved.
Glad to see you are on top of things..

First dib's on being your driver. I have no patience to be a booker as I would also comment "Can you not read the fucking schedule or make up your fucking mind " ( things I have been guilty of by the way ).
If you were in need of a man whore I may fit the bill but a 1 shot kind of guy, 30 min appointment max.

Long posts, smaller font!

You do realize guys that I was/am talking about the specifics of legally consulting on the 'business model' of an escort agency in Montreal... right?

especially when it is not illegal to operate an escort agency for companionship purposes.

That distinction allows an attorney to advise clients on how to offer and how to purchase time and companionship, instead of sex.

Take the current AOY and try to consult with that explanation.

Essentially, those attorneys will review the activities that have gotten others arrested, and how the arrested person might have conducted his or her activities in a manner that would have avoided arrest. That is not conspiring with the client as to how to commit a crime. That is educating the paying client as to what the law says, and how the enforcement of the law works. That counseling happens every day in all areas of the law.

Talking about Criminal Law (which has a different starting point than any other area of the Law): did your US friends tell you how many of their questions their lawyers refused to answer during such counselling?

Yes of course lawyers will agree on seeing clients, after all time is money, but not on providing responses to the delicate questions…….

Unbelievable how 2 people want to sidetrack this discussion by asserting there's not a single attorney in Montreal who would consult on these matters

So you can see Arthur that I never said that an attorney would not accept the appointment. Plus I was answering STN's questions... so which "sidetracking" please?

If an innocent person, such as an escort of an escort agency, that sells time and companionship consults with an attorney as to how to minimize the chance of being arrested and falsely accused of selling (or helping someone else sell) sex, the attorney can offer examples of how other purportedly innocent people were arrested, what actions likely led to their arrest, and how they could have done things differently to have decreased their chance of arrest. And in reality, who in this hobby can really claim innocence?

Yes, including both men and women... who?

As Booker said:

Morning follow up

what is wrong with going to a lawyer and propose to them what your business model is and ask for their professional advice.

So why did you ask that question at first since clearly, as per below, you know better... ?

Thank you for your take on this but, never knew there were no lawyers that worked outside of the law and were completely law biding. Guessing that all the top lawyers that the mafia or bike gangs have are just C grade lawyers that are trying to get into the business.
There is a away around most things and there are plenty of lawyers who would be glad to assist almost anyone who has the right amount of cash. The consulting to commit a better crime would not have to be written down in any books as such.

Food for thoughts: speaking of the right amount of cash, ever wondered why the Mobsters, Bikers and Friends are not that obviously involved in the business?

EDIT: Do you really think what goes on behind the closed doors of a lawyers office is completely legal all the time? serious.. A lawyer?

Illegal stuff happening behind closed doors... no way! Closing my eyes on this!!!

Several would probably work pro bono. Especially in this case

Working Pro Bono in the case of an agency being C36'ed?

Unless it is family related or something along those lines, I very highly doubt this one.

feminist-induced law is an ass!!!!

It would not be 'an ass' if it was feminist-induced trust me!!!!

A great day to all, cheers!

I really don't understand the need of a lawyer. The law is clear and simple. It is a waste of time to try to find loopholes. If you play with fire you need to be ready to face the consequences and not try to bullshit yourself out of the situation. Playing with technicalities are for pussies when you are fully aware of what you are doing.
