In October 2008 I got a ticket for a moving violation in Montreal. The police were not issuing tickets because they wanted more money. Many cops did not hand out tickets. This cop looked at my papers and sent me on my way without a ticket or explanation. I got a notice to pay or appear in court, I chose to go to court. I just got a copy of the ticket today and the part where the cop attest that he witnessed the incident and where he identifies himself ( badge number, name, unit and section ) is not filled out. Also, the new tickets do not have a place for the cop to to affix a signature. I heard that some people are challenging the legaity of the tickets without cop signatures.
Questions :
- If the cop has not filled out the portion of the ticket where he attest to the fact that he witnessed the incident, is the ticket valid?
- There is no name of the cop, badge number, section or unit in the places where he has to indicate this. It is blank. Does this invalidate the ticket?
- If the cop has no place to affix a signature on to the ticket is this ticket. Will this ticket be invalidated?
