Moving violation traffic ticket - Cop did not fill out his name or badge number.

In October 2008 I got a ticket for a moving violation in Montreal. The police were not issuing tickets because they wanted more money. Many cops did not hand out tickets. This cop looked at my papers and sent me on my way without a ticket or explanation. I got a notice to pay or appear in court, I chose to go to court. I just got a copy of the ticket today and the part where the cop attest that he witnessed the incident and where he identifies himself ( badge number, name, unit and section ) is not filled out. Also, the new tickets do not have a place for the cop to to affix a signature. I heard that some people are challenging the legaity of the tickets without cop signatures.

Questions :

- If the cop has not filled out the portion of the ticket where he attest to the fact that he witnessed the incident, is the ticket valid?

- There is no name of the cop, badge number, section or unit in the places where he has to indicate this. It is blank. Does this invalidate the ticket?

- If the cop has no place to affix a signature on to the ticket is this ticket. Will this ticket be invalidated?

I think that if any part of the ticket is not correct , you can ask for the ticket to be dismissed..

But years ago, I got a $ 150.00 parking ticket in Chinatown in NYC

I heard of a program where I was able to argue my case via letter

The people that mediate these cases are retired judges who do a small amount of hours per week for free..

You know what- he liked my argument so much, that he wrote me a letter, with a copy of the ticket, telling me that I presented my case very well

He reduced by 150.00 ticket to 15.00 for " court costs "


You never know until you ask..

Go early to court..maybe you can talk to the prosecutor ??

In avril 2008, the cop told me an access speed of 90km/h in zone 50km/h, I received a ticket almost 500$ and lost 6 points, Before the cop gave me the ticket, it's supposed to show me the speed 90km/h in his radar camera, at this moment he told me it was not found, I supposed maybe accidentally he was deleted it. I had not gone to judge, I paid the ticket finally, because I had too many things to do. I still wonder today if I could have gone to judge to protest, because he did not show me the speed in his radar camera. I know it's too late already, but I would like to have your advice for next time?

In quebec the police officer word is enough he does not have to show you the radar reading A mistake on the paperwork get a lawyer and good luck

Check this... usually the charges have to be layed within 6 months of the offense...
