Is the new prostitution law forbiding the purchase of webcam show? This website, question #2, seems to imply this: https://www.justice.gc.ca/eng/rp-pr/other-autre/c36faq/

The whole law is totally ridiculous.
That is what it seems to imply.
The idea that you can legally sell something but at the same time is punishable by jail time to buy Is totally insane to begin with.
I just wonder when this will finally be legally challenged in court.

It’s a gray area but the greater risk is to a site such as Chaturbate which is advertising the purported “sexual service.” That’s who prosecutors would go after. But the additional culprits in any case would be the banks and credit card companies allowing those transactions for “tokens.” That’s a whole other can of worms that no politician or prosecutor is likely to open. I don’t see any crackdown on web cam sites happening without serious blowback on politicians and prosecutors. They’d be laughed out if town.

As far as the customer, given the online nature of the business, the reasonable defense is that the customer was procuring an “entertainment event“ and not a “sexual service“ for the purpose of sexual gratification.

And unless they confiscate your keyboard for evidence of sexual gratification I don’t know how prosecutors make a reasonable case against an individual in an online environment featuring consenting adults.

I hope it will be that simple to be acquitted once accused of paying for sexual services.
Luckily here in Quebec LE only seems to beat its chest for a short while during F1 week to show the media that they are actively doing something.
Afterwards they let adults be adults and concentrate on more money making ventures like speeding and parking tickets.

I think you are okay if you are not directing the action by making requests.

You are buying her time and her production. In escorting, you are buying her time and companionship. It must be really easy te prouve in the webcam world, because there is a track record of the transaction and the girl is not only smelling flowers on cam... whether the client asked for specific acts is not relevant... he knew what he was purchasing. And most of the time the girl asks the client what he like...

Nevertheless, a law that is not enforce becomes eventually unenforceable in court. There is a lot of jurisprudence about this, I remember that much from my days working in enforcement years ago. But the nerves of the Harper government! They were not all pure and white, remember Tony Clément's sexting scandal. But they judged others on higher morale then they did themselves...
