Yes, that was the experience of a friend of mine as well, the first time he applied to get one from the Americans. He now has a five-year waiver. What he can't get is a Nexus card.

I heard this when it was on live and I was in hysterics! He brought it on himself by acting like an arrogant jackass to the Immigration official though.
