How does the judicial system should look at it is more the question without emotions .
No jail time for two deaths what type of message would that be sending it might open a way for people to kill others without jail time ,A bad precedent would be set .
It is not black or white many consequences may be triggered out of this decisions how do we consider Criminal intent a car accident when no speed is involve no impaired driver ?
How should the trial judge instruct the jury ,
The laws are there so people will conduct themselves in a proper manner and so other people will not repeat the same actions .If there is no consequences to the killings what gap are they opening in the judicial system ?
Sadly for the person involve even if she is not of a criminal life style others are looking at ways to commit murders without consequences ?
Black widows do exist and organize crime and hit mans
It is a question for the Wise man and Women in the higher courts system to consider .
I much prefer in this case to be in back seat than the ones deciding because it is not only the fate of one person are at stake ?
The hole criminal system is being tested on the Criminal intent causing death ,the answer they will provide will set precedent on witch other similar cases will be judge and decided !

Drunk Drivers knows very well what may happen, there so much campaigns and such, and you don't need to be a 100 watts to know when you drink your senses are altered......of course driving a car would be an absolute no go..

C'mon, how many watts does anyone need to know it's dangerous to stop in the middle of the highway, not the wrong side, during rush hours. Would that be 1...or 2. Really, how many times have you or anyone else just stopped in front of traffic. Try ZERO!!!

This was not "a mistake". A mistake is something you failed to realize, a judgment call in error, a poor choice when you did not know the answer. In this case any moron with 1 IQ point knows it's dangerous to just stop in the middle of the highway and knows it will cause risk to others. Parking in the high speed lane wasn't questionable like a mistake, it was deciding to create the danger.

There's all kinds of incredibly stupid people doing hard time. Do you suggest the doors be opened for theft, rape, murder, larceny, arson, blackmail, etc, because the criminals are stupid.

Some people have been saying, well, criminals who have done much worst got away with little time or none so you can't put this woman in prison because it would be unfair to make her pay when killers didn't. According to that line of logic we should eliminate any justice system because Al Capone and OJ Simpson got away with murder. We know there are big holes in the system so because not everyone gets there due punishment we should abandon any punishment for anyone????? Ohhhhhhhhh puuuullleeeeeze. How ridiculous!!!

The woman KNOWINGLY endangered lives and got two people killed by creating the danger. The dead father and daughter paid a very heavy price, with their lives, just for going too fast. No one has offered any credible reason why the woman shouldn't pay a little time for her part in getting them killed...certainly a much, MUCH smaller price.

Two lives...quite a high price for failing to do the most obvious and safe thing for her and the others.

Now ok i do understand now why people are upset about her... She should had go to the side... I just tough she was find guilty because of behind on the side, but on the WRONG side...

Or at least saw a picture?

I assume there was no median and also no left emergency stopping lane to pull off onto as is the case with many Quebec highways.

If you look at my previous post quoting the article report the ducklings were in the "median". If there hadn't been one I don't see how it would make any possible difference to the insanity of stopping in front of traffic in the high speed lane.

I'm an animal lover also, but the lives of ducks over humans...NEVER. When I came back from Montreal the last time I had just crossed the border back into the U.S.A. just South of Highgate in Vermont. Traveling at about 73 MPH I was just passing a car when I saw a bird standing in my lane just ahead. As I approached I noticed it was a dove and expected it to fly off before I got to it. It didn't. I did the smart thing. I decided not to risk my life or that of the other driver by swerving one way or the other toward the other car or into the median ditch. The dove was killed, unfortunately, but two people went on safely with their lives. Too bad this woman didn't have the same sense. Her choice cost two lives.

Its is really a sad story and never ending one because of the ramifications it involves for future duplicate cases . Stopping on the highway to take care of ducks and kill two innocent people what a tragedy .
I agree with Merlot we can be animal lover ,but humans have priority !
Has for the judicial system well they have a hot potato to handle ,our law system is based on precedents and interpretation of the law by the higher Courts after the Quebec court of appeal will have ruled on it and its not appealed to SCC all the first instance court in Quebec will bounded by it .
To think someone can get a free pass on murder is a little scary don't you think?

Well by making certain choices you do decide without necessarily realizing at the moment !
She decided to protect the ducks, what resulted out of it is the death of two humans !
Choice was made its the results that count in this case ! Sadly

I can understand that if the highway passes through a built-up area and there is no space for a reasonably wide shoulder but in this case.....this type of highway design is irresponsible and should have never been allowed.
I must say I expected the area where the accident occurred to be in a curve with the visibility of the stopped car being blocked - not a perfectly straight stretch.

You're right. In the moment she didn't. What I said was a very generalized philosophical portrayal. I don't think for a moment she was thinking of a choice between people and ducks. That is my real problem with what she did.

I've been in Montreal traffic on highways at all times of the day. Just Like the highways in and around many other large or busy cosmopolitan cities drivers practically never give anyone a break. They charge through at the slightest opportunity. It's the same around Montreal. Don't you think she's been around enough even at her age to know that and realize how dangerous it could be for even a cautious person. Who of us would ever just stop and get out with the door open in the high speed lane with traffic. No one. It's an invitation to the hospital or the morgue. Yet despite the fact it barely takes a brain cell to know the danger, she just stops the car and gets out for ducks thoughtlessly without consideration of her life or that of others. What kind of mindset has developed in a person that would allow anyone to do that??? What kind of consciousness or lack of is in her psyche to fail to consider and register the danger instantly in her mind??? It's freaking scary.

It's a scenario in which anyone should have instantly realized without thinking about it that stopping there is nuts. Yet she did it anyway. :crazy:

On the surface she made the choice between human lives and ducks, but in reality she was too disconnected from the reality of what she was doing or she wouldn't have. There's the problem. She saw ducks and simply stopped in dangerous traffic, got out risking lives, hers and others with seemingly no consciousness of the risks of her actions. She needs to be put away for a while; prison, counseling, psyche ward. One way or another she should not be allowed out in the world until she can learn to think responsibly enough to know the choice she made and be able to recognize the danger.

Choice was made its the results that count in this case ! Sadly

9 months and she'll be out in far less than that. Hopefully this will be a lesson to other drivers to be as considerate of human life they are of animal life.

However you try to argue her position, that was a very stupid move that cost 2 people their lives for a couple of ducks.

She is very lucky she did not lose her life herself.

The amazing thing is that I've heard people say they would do the same. I did not argue with them, just stupid....
