Watching the video the first thing that has to be suspected is that the pilot of the helicopter had a medical event rendering that person unconscious. The lights on the plane were bright and blazing, hard to imagine they were not seen unless the pilot fell unconscious and did not see as a result.
When a sudden and unexpected medical event happens on the road, like a sudden and massive heart attack, it is nobody's fault. In my legal career I have defended the Estates of 2 different clients who lost consciousness due to massive heart attacks and caused huge motor vehicole to motor vehicle accidents. Unless there was a failure to take a prescribed medication, there is no actionable negligence. It's just an accident with no fault assigned.
