How are you using the word "entrapment"? All these parties whether it be the massage parlor or the college admissions were committing crimes with co-perpetrators not government agents.

I’m no lawyer but from Wikipedia this is the definition of entrapment: “In criminal law, entrapment is a practice whereby a law enforcement agent or citizen induces a person to commit a criminal offense that the person would have otherwise been unlikely or unwilling to commit.” So it doesn’t have to be a govt employee. There’s a lot we don’t know about Kraft (did the girls know they were being taped? The mamsan?) but he could argue that he went in for a legal massage and the girl was just sooo hot he couldn’t resist the extras she offered. Not likely to succeed but it’s a cover story I suppose.In the case of the college cheating, I bet that some parents will argue that it never occurred to them to cheat to get their lil darlin’ into USC but once the offer was made (with reassurances that it’s done all the time) they just couldn’t resist. I suspect that this will, in some cases, have a bit more traction esp if there’s lots of legal muscle behind it.

In the college admissions scandal, I can only see the entrapment being used as a defense if the "admissions consultants" were already busted and cooperating with the FBI to lure and entrap parents. That's very possible.

However, if parents called these admissions consultants (even if they were already cooperating with the FBI) and initiated discussions to buy spots on athletic teams and to hire test surrogates, it would be appear to be a more difficult case. Since most of us learn law from Hollywood, it seems that when a criminal is wired he needs to only get the other person to initiate the discussion of committing the crime.

I don't think anyone is going to jail for the admissions scandal. Besides the personal embarrassment, there will be large fines and community service. I presume they can hire someone as their proxy for community service. Lol.

What would be sweet is if they could take down some admissions people within some prestigious university admissions departments. That is probably wishful thinking. Additionally, the high-level university administrators are probably cordoned off from such abuses even if they might have been aware something was up.

But a jury may ignore the lack of true evidence against a guy like Kraft who may have just paid extra with no real indication of soliciting or purchasing sex, because the jury really doesn’t like the look of rich guys paying $120 to a poor Asian lady.

Perhaps that is why Kraft requested a bench (that is to say, judge-only) trial.

But by balking, he might get a better offer in a few weeks.

Seems pretty obvious to me. In any case, how can a serious person take the very first deal he is offered? Especially if his best buddy wrote a small book called "The Art of the Deal"?

He is getting the standard first time offender offer. It's not even really a deal, it is just the standard thing. It was reported in all the articles three weeks ago when he was arrested. As far as video, wasn't it the cops who videoed him after they got a warrant to bug the place? How can he sue them for that?

Well, there is that little pesky thing called "Expectation of Privacy" -- and the question is whether his Fourth Amendment rights were violated. So the first step would probably be to hire a good lawyer. I hope he can afford one.

He did get the standard first time offender offer, not a "deal." Negotiations will occur but they will not result in that "deal" because it is not any kind of deal.

As to your second question, governmental immunity defenses would be a huge roadblock to any such lawsuit. Here, such a lawsuit usually gets dealt with by dispositive motions to strike or motions for summary judgment.

I do think Kraft may have some issues down the road, and whether that video comes into evidence or not is not the end of the case. The biggest issue in my mind is that at some point, file sealed or not, win or lose in court, that tape is gonna get leaked. Someone made a copy of it knowing its value and knowing TMZ will put in a great bid. For some $10 an hour clerical employee at the local PD, getting fired may be a voluntary, economic decision if TMZ offers enough money. So the media reports suggesting that Kraft has an interest in accepting that "deal" to get the tape sealed are overlooking the likelihood that copies have already been made for illicit sale at some later date.

The chances of viewing Kraft's cock being jerked or sucked (if anyone here is actually interested in such a viewing) is in my mind going to be possible or even likely regardless of what happens in this case. Apart from TMZ which simply has an interest in profiting from the usual sensationalism, there are Kraft's enemies, of which there are a few, and then there are the would be or wannabe owners of the New England Patriots, whomever they may be, whose motive would be to get him banned from the NFL if the criminal justice system and woman's rights groups do not succeed. The latter is already seeking a ban. Dislclosure of the tape would possibly lead to a forced sale - a la Donald Sterling sale of the LA Clippers after a tape got released exposing him as a racist dude, which was fatal to his professional sports involvement. He was a suck ass owner anyway and nobody has missed him. But it could happen to Kraft, especially if the tape gets released.

So the owner of such copy of such tape can basically auction it to all of the above. High bidder wins just like with Michael Jackson's medical records that got released (and Michael Schumacher's medical records after his skiing accident). This is the reality of what is out there and especially when the public has all been made aware of the value of the tape.
