A man who refuses to wear a condom during sex despite a request to do so by his or her partner should be guilty of sexual assault, the Supreme Court ruled in a decision handed down Friday.

The Supreme Court of Canada rules that when a person is required by their partner to wear a condom during sex but does not do so, they could be guilty of sexual assault.

I think it's fine under these conditions:

  1. The woman gets the man to sign a form promising to wear a condom before sex begins.
  2. The man's signature is notarized.
  3. There is photo/video evidence of the man inserting his penis without a condom in the woman's vagina.
  4. There are at least two impartial witnesses to the sex act.
  5. Within 24 hours of having unprotected sex, the woman must report the unwanted, condom-free sex to the Canadian Organization for Nonlegal Deceptive Outlawed Manhood (CONDOM).

Back to the subject, no question if a condom is requested it should be used, but there should be more to getting someone in trouble with the law than just the word of the woman.

With all this crap going around, I've been getting tested every 6 weeks (especially since I had a couple condom mishaps recently). As a fat old guy getting tested every 6 weeks, I'm sure my doctor knows what I am up to :cool:
